Insurance schemes

The NZFWDA has poliices that cover the association, the committees, affiliated clubs and the members.

Public Liability policy

The Public Liability policy indemnifies the above mentioned parties for acts of negligence whilst working for, or participating in, the association or an affiliated club's activities. It does not cover one member damaging another member's vehicle whilst participating in an event. The policy is subject to a $500 policy excess.

The cover is as follows

  • General Indemnity $10,000,000
  • Goods Products¬†$10,00,000
  • Forest and Rural Fires Act $2,000,000
  • Punitive and exemplary damages $1,000,000
  • Personal Injury $ 5,000,000
  • Statutory Liability $ 250,000

Statutory Liability policy

The Statutory Liability policy is a cover for $250,000 and is also subject to a $500 excess. It indemnifies the above parties for their legal liability for fines and penalties under most Acts of Parliament but does not apply to some Acts. For example the Crimes Act, The Land Transport Act, most sections of the Inland Revenue Act and other criminal type offences are excluded. The main reason for this cover is to provide protection for Penalties under the Resource Management Act (e.g. an oil spill in a stream or similar).

Legal Defence Costs policy

The cover is for $250,000 and there is no policy excess. Protection is provided for legal fees to defend members against criminal charges related to event activities (an example was a MotorSport NZ incident a few years back when event officials got charged by the police in relation to the death of a spectator). The idea is that legal fees can be provided, so that such costs do not come out of a member's own pocket. The insurance does not cover penalties imposed by the Court.

Please note that all these insurances only apply whilst participating in an event run by the association or an affiliated club. Activites that create a commercial benefit for other parties may not be covered. If in doubt contact the NZFWDA National Secretary.
