The NZFWDA is the national body for many of the four wheel drive clubs in New Zealand and represents 52 clubs with a combined membership of 2400 individuals. That number does not take into account the families of those members and nor does the NZFWDA lay claim to the thousands of four wheel drive (4x4) vehicle owners who choose not to belong to an organisation. It is important to realise that the 4x4 vehicle is predominantly simply a means of getting New Zealanders to the outdoors. In the heyday of tramping clubs, the availability of a family vehicle that could tackle some of the lesser routes into the backcountry was very limited and most tramping clubs used ex-military trucks with at least 4x4 capability to drive groups as far as possible before starting the walk. What has changed is that there are now family sized 4x4 vehicles that allow people to make choices of where they go and who they go with. It would be a rare situation that would see a walker leave their vehicle at home and walk to their distant destination. That is why the NZFWDA has a strong aversion to many aspects of this Bill. It implies that vehicles are unwanted and unnecessary to the enjoyment of our outdoors. The imposition of walkways on legal roads, even if unformed, is a discriminatory action that threatens to limit a significant proportion of the population. With an aging population, the desire by many New Zealanders to continue their love of the outdoors and adventures is often restricted by the effects of their previous outdoors activity with aging joints, etc. limiting their ability to walk very far. A high proportion of NZFWDA members are in that category and to restrict vehicle use on, or encourage changes in designation of legal roads, is certainly discriminatory. The only recognition to disability in the Bill is allowance for a wheeled non-powered personal mobility device. Families are another group who are able to enjoy the ability to use vehicles on the network of unformed legal roads. Introducing children to the outdoors is a failing trend in NZ and by reducing opportunities through limiting vehicle use of those roads laid out by our forefathers with such vision is unacceptable. NZFWDA members took an active part in contributing to both the Walking Access consultation reports of 2003 and 2007 and largely accepted the position of the final report while acknowledging the dissention of Mr Bryce Johnson as the only recreational organisation representative on the Panel. The eventual Bill as presented is a strange interpretation of the recommendations of that 2007 report which clearly emphasised than an Access Commission be established to cover a wide range of recreations, not just for walking! New Zealand is privileged to have had in the past, people with vision, who set aside land for public use in the form of a surveyed network of legal roads that in many cases included lands alongside water bodies. The Bill incorporates the elements of the earlier legislation on Walkways, despite it being apparent that those previous laws have proved to be ineffectual. By recycling past legislation, there are also anomalies repeated such as Section 6 of the Walkways Act 1990, enabling use of unformed roads as walkways. That clause is described by Hayes as a curious provision which is inconsistent with the common law, the statutory law protecting the status of roads, and the rigorous protection the New Zealand courts have provided for the interests of the public". There are some functions of the proposed Commission that might benefit the provision of access and related recreations in the outdoors but the imposition of walkways over public land such as reserves or unformed roads is completely unnecessary. In a response to questions about the Bill, to the office of the Minister, states There are few if any formally gazetted walkways that at present traverse unformed legal road, and it is not expected that there will be widespread use of unformed legal road for walkways. Access over an unformed legal road does not require it to be gazetted as walkway. However in an article written by Mr Brian Stephenson, Federated Mountain Clubs President and a member of the Advisory Board involved in setting up the Walking Access Commission, he states In securing new walking access, registered easements are likely to be the handiest instrument. Unformed roads will also have an important part to play. Public lands (apart from wildlife sanctuaries) already have the right of walking access, so there is no need to add walking rights! The NZFWDA recognise private property rights and agree that any travel on private land must be by agreement with the landowner. There must be provision to compensate landowners for the effect of allowing a walkway to be established on private land through negotiation. The Government department to administer a Commission is crucial to its success and the use of Ministry of Agriculture and Forests (MAF) is untenable and creates a conflict of interest. MAFs role is to serve rural landowners. As the Department responsible for compiling the background consultation, its weighting in favour of rural interests and the absolute minimal representation by recreation interests on the Panels demonstrates its unsuitability. The Department of Conservation should retain the responsibility for the existing NZ Walkways but it is also not apparent that there is an interest by that Department in the overall needs of recreation in the outdoors. A strong emphasis by the Acland Panel was for the identification of existing access options through our countryside. That would allow better use of what is now available. To date, the rural community have, in the main, regarded unformed legal roads as being on their land. That attitude is as difficult to manage as that of some visitors who ignore common courtesies or the law in general. It is accepted that adjacent landowners may wish to manage the vegetation on a bordering unformed road in the absence of management by the controlling authority. An unformed road can provide a useful land area to those adjacent and is effectively free land. As the key to identifying land tenure rights are the maps available to the community it is essential that a Commission rapidly addresses the concerns that such information is difficult to obtain by the public. With the knowledge in that area being with Land Information New Zealand (LINZ) and with that Department being effectively neutral in respect of rural/ recreation, it may be a valid Department within which to site an Access Commission. The Bill does require that a Commission follow a process for converting a road to a walkway but is largely silent on the existing ability under the Local Government Act provisions for the resumption and disposal of unformed roads. Resumption is already too widely used to circumvent the public process and the opportunity to appeal to the Environment Court. In its present form the Bill is likely to increase the resumption and disposal of roads. Unless this Bill is dramatically changed or withdrawn there is the probability that the public at large will lose a tremendous public asset for our access, by the resumption and disposal of unformed and old roads without public process and by declaring the remaining unformed or old roads to be walkways and turning them into little more than private rights of ways. New Zealand needs an Access Commission, not a Walking Access Commission. The limitations defined on designated walkways under the Bill will frustrate many recreational users of the outdoors. The costs associated with maintaining facilities for one recreational sector at the expense of many others are unwarranted. Maintenance materials will need to be transported and the use of vehicles is recognised in the management of walkways when necessary. Adjacent landowners will have the right to use vehicles. A successful Bill would include a wider permission regime to allow managed vehicle use of public access corridors other than legal roads. In conclusion the NZFWDA; Demand the removal of all provisions in the Walking Access Bill 2008 for declaring walkways over public land, including roads- formed or unformed. Require that NZ Walkways remain with the Department of Conservation and that the Walkways Act 1990 remains separate from the proposed Bill. Does not want a rural aligned Ministry, or Department of Conservation as the site of a Commission. LINZ is the suggested site. Requires that at least three members of a Commission board are nominated by outdoor recreation interests. Requires that a Public Access Commissioner can consider a wider range of access issues than simply being able to walk without a gun or a dog, i.e. along the lines of Section 10 (i). Requires that a Commission be an Access Commission with a wider recreation viewpoint than simply establishing Walkways. The NZFWDA would like to speak to these comments.
